Terms of Use

1. Agreement to the Terms

Your access to or use of A-TRACK, including the website, APIs, SDKs, dashboards, hosted services, documentation, and related software or support, constitutes your agreement to these Terms of Use. If you do not agree, you may not use the Services.

2. Eligibility and Accounts

You may use the Services only if you are legally capable of entering into a binding agreement and are not prohibited from using the Services under applicable law. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You must provide accurate account, billing, and registration information and keep that information reasonably up to date.

3. Use of the Service

You agree to use the Services in compliance with applicable laws, regulations, and these Terms. You may not misuse the Services, interfere with their operation, circumvent security controls, attempt unauthorized access, or use the Services in a way that degrades platform stability for other customers.

Tech Face LLC may enforce fair-use thresholds, throughput limits, feature restrictions, or abuse prevention controls where necessary to protect the platform.

4. Customer Data and Responsibility

You remain responsible for the data you submit to A-TRACK, including the legality of collection, the existence of any required notices or consents, and your instructions regarding processing. You represent that you have all rights and permissions necessary to provide Customer Data to the Services.

5. Fees and Billing

Some Services may be offered on a free, trial, usage-based, or paid subscription basis. Unless otherwise stated in a written agreement, paid plans renew automatically for the billing period selected by you. Fees are generally non-refundable except where required by law or expressly stated otherwise.

Tech Face LLC may update pricing or billing terms on prospective notice. Continued use of the Services after the effective date of a pricing change constitutes acceptance of the new pricing.

6. Privacy and Data Processing

Use of the Services is also subject to the applicable Privacy Policy, Cookie Policy, and, where applicable, the Data Processing Addendum. Those documents are incorporated into these Terms by reference to the extent relevant.

7. Intellectual Property

The Services, including software, documentation, trademarks, branding, interface design, and underlying technology, are owned by or licensed to Tech Face LLC and are protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

You may not copy, reverse engineer, decompile, disassemble, resell, frame, or create derivative works of the Services except to the limited extent such restriction is prohibited by law.

8. Feedback

If you submit ideas, suggestions, enhancement requests, or other feedback regarding the Services, Tech Face LLC may use that feedback without restriction or obligation to you.

9. Service Changes and Availability

Tech Face LLC may modify, suspend, or discontinue all or part of the Services from time to time, including for security, legal, operational, or product reasons. We will use reasonable efforts to provide notice where practical for material adverse changes to paid Services.

10. Third-Party Services

The Services may interact with or contain links to third-party services, sites, infrastructure providers, or software. Tech Face LLC is not responsible for third-party services except to the extent expressly stated in a separate written agreement.

11. Suspension and Termination

Tech Face LLC may suspend or terminate access to the Services where reasonably necessary to investigate abuse, protect the platform, respond to legal requests, prevent fraud, address non-payment, or stop conduct that violates these Terms. You may stop using the Services at any time, subject to any payment commitments in an applicable order or subscription.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. Tech Face LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, Tech Face LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, business opportunity, goodwill, or anticipated savings. Any aggregate liability will be limited as provided in the governing agreement, order form, or, if none exists, to the amount paid by you to Tech Face LLC for the Services during the twelve months preceding the claim.

14. Governing Law

These Terms are governed by the law specified in the applicable customer agreement or, if none is specified, by the law designated by Tech Face LLC in its commercial documentation. Venue and dispute resolution procedures may be further described in the applicable order, MSA, or negotiated agreement.
